The legal entity of the Church is created in the Uniting Church in Australia Act 1977 (NSW) (“Act”) by the establishment of the property trusts as statutory corporations to acquire, own, deal with and dispose of property for the benefit of the Church.
The property trusts created by the Act to deal with the acquisition, ownership, dealings and divestment of property in the Northern Territory is The Uniting Church in Australia Property Trust (NT). The General Secretary of the Northern Synod is the Property Officer of the Property Trust (NT).
The Property Trusts are the legal owners of all assets, real and personal, of the Uniting Church and the Uniting Church is the beneficiary and are the only bodies that can be noted as the registered proprietor of land, initiate proceedings or be litigated against.
Unless otherwise delegated in writing, the members of the Property Trusts are the only persons authorised to execute documents on behalf of the Property Trusts.
This legal title should be used for all property related documentation with vendors, suppliers and regulatory bodies.
Any documentation requiring signatory approvals should be sent to Finance and Property Services Committee for signing by the Property Trusts authorised signatories.
